1. Introduction

Please read these Terms of Use ("Terms") carefully before using the Aueli mobile application ("the App") operated by Zeppay B.V. ("we", "us", or "our").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the App.

2. Account Registration

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our App.

You are responsible for safeguarding any passwords or credentials used to access your account and for any activities or actions under your account.

3. Content Generation

Aueli uses artificial intelligence to generate recipe content based on your preferences. While we strive to provide accurate and reliable content, we cannot guarantee that the generated recipes:

• Will always meet your dietary requirements or preferences
• Will be entirely original or unique
• Will be error-free in measurements, cooking times, or instructions
• Will produce results as described or expected

You acknowledge that you are responsible for verifying that recipes meet your dietary needs and requirements, especially if you have allergies or medical conditions that require dietary restrictions.

4. Subscription and Payments

Some features of the App may require a paid subscription. By subscribing to Aueli Premium, you agree to the following:

• Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store
• No refunds will be issued for partial subscription periods

Pricing and availability of premium features are subject to change without notice.

5. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Zeppay B.V. and its licensors. The App is protected by copyright, trademark, and other laws of both the Netherlands and foreign countries.

Recipes generated through the App are provided for your personal use. You may not use these recipes for commercial purposes, publish them in cookbooks or on websites, or claim them as your own intellectual property.

6. User-Generated Content

Users may provide feedback, ratings, and other information in the App. By providing this content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with the App.

You are solely responsible for your user-generated content and the consequences of posting or publishing it. You represent and warrant that your content does not violate any third-party rights, including copyright, trademark, privacy, or other personal or proprietary rights.

7. Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal, non-commercial purposes. You may not:

• Modify, copy, or create derivative works based on the App or its content
• Use any data mining, robots, or similar data gathering methods
• Remove any copyright or other proprietary notices
• Transfer the App to another person or "mirror" it on any other server
• Attempt to decompile or reverse engineer any software contained in the App

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App is free of viruses or other harmful components.

9. Data Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as detailed there.

We use third-party services, including OpenAI and RevenueCAT, which may collect and process data. Please refer to these services' privacy policies for more information.

10. Limitation of Liability

In no event shall Zeppay B.V., its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
